Jakarta (ANTARA News) - Temasek Holding of Singapore is confident its appeal against the Business Competition Supervisory Commission (KPPU)`s ruling that it had violated the country`s anti-monopoly law will be successful, the company`s lawyer said.
"We are sure the court will accept our request to revoke the KPPU`s decision," Temasek`s lawyer, Todung Mulya Lubis, said at a Temasek-hosted function here Wednesday.
He said the company was now only waiting for a summons from the Central Jakarta District Court to attend hearings on its appeal.
The court had postponed the hearings pending a decision of the Supreme Court on which district court would handle Temasek`s appeal, Todung said adding that the choice would also depend on the KPPU`s preference as conveyed to the Supreme Court.
"We filed our objections to the KPPU`s decision at the Central Jakarta District Court so it is this court that should take up our case but we don`t know for sure as the Supreme Court could well decide otherwise," he said,
Temasek submitted its appeal against the KPPU`s ruling to the Central Jakarta District Court on Tuesday (December 12, 2007).
On the occasion, Temasek`s Corporate Affairs Director Deliea Mohamad said the company was unaffected by the KPPU`s ruling and would continue to invest in Indonesia.
"We remain committed and we believe in the potential long-term prospects in Indonesia and in ASEAN," she said but declined to elaboroate on Temasek`s business investment plan in Indonesia for 2008.
The objections to the KPPU`s decision to declare Temasek`s investment in two Indonesian telecommunication companies a case of cross-ownersip that violated the country`s anti-monopoly law were forwarded by nine entities belonging to the Temasek Busines Group, namely Temasek Holding Pte. Ltd., Singapore Technologies Telemedia Pte. Ltd., STT Communications Ltd, Asia Mobile Holding Company Pte. Ltd., Asia Mobile Holding Pte., Indonesia Communications Limited, Indonesia Communication Pte., Singapore Telecommunications Ltd., and Singapore Telecom Mobile Pte. Ltd. (*)
