Two airlines – Singapore Airlines and Emirates SkyCargo – are seeking to block the Australian Competition and Consumer Commission’s demands for documents relating to inbound cargo as part of the ACCC investigation into price fixing in international air freight.
The two airlines say the watchdog has limited powers to police cross-border transactions and say the market for air cargo into Australia is not an Australian market under the Trade Practices Act.
The application from Emirates argues that international air cargo carriers compete for customers at the point of origin of the cargo regardless of the location of the customer, so that inbound freight does not constitute a "market in Australia".
